The article provides a legal analysis of the procedure for the Ukrainian SSR to secede from the USSR. The analysis of all‑Union legislation, referendum ballots, voting results, and scientific literature yielded the following research findings: Ukraine’s sovereignty is illegitimate, as the rights of all nationalities to their free national and cultural development were not guaranteed in accordance with the Declaration of July 16, 1990; on December 1, 1991, violations were committed in the procedure for holding the All‑Ukrainian referendum on the declaration of Ukraine’s independence; the Republic of Ukraine seceded from the USSR illegally; the Republic of Crimea did not legally secede from the USSR. It has been substantiated that during the All‑Ukrainian referendum on December 1, 1991, the referendum documents and voting results were falsified, since the majority of the Russian population in the southeast of Ukraine could not vote in favor of leaving the USSR; thereby committing a crime against the people and against the territorial integrity of the Russian Federation.
USSR, Ukraine, sovereignty, people’s rights, referendum, violation of territorial integrity, falsification of referendum documents, falsification of voting results
