The article is devoted to a comprehensive analysis of the institution of personal bankruptcy in the Russian Federation. The paper examines the legal mechanisms for declaring a citizen insolvent, the main stages of the procedure (debt restructuring and property sale), and the role of the financial manager. It is crucial to note that personal bankruptcy does not immediately relieve a person of all their obligations. For example, debts related to child support, compensation for moral damages, fines, tax liabilities, and medical expenses remain even after the bankruptcy procedure is completed. There is also a prohibition on re-appearing in court in a bankruptcy case within five years of the completion of the process, if a waiver of debt exclusion was previously issued. Special attention is paid to practical risks, such as the challenge of transactions and subsidiary liability, and the legal consequences for the debtor. The purpose of this article is to provide a balanced overview of the opportunities and challenges of bankruptcy as a financial recovery tool, offering practical recommendations for all participants in the process.
